Terms of Use
A little push for your morning. Pushy provides alarms and optional wake-up challenges. Device settings and iOS control delivery, audio, and system alarm controls; uninterrupted ringing cannot be guaranteed.
1. About these terms
These Terms of Use govern your use of Pushy, provided by its developer (“we,” “us,” or “our”). By using the app, you agree to these terms. If you do not agree, do not use the app. You must have the legal capacity to accept these terms, or use the app with an appropriate parent or guardian’s permission.
2. App use and license
You may use Pushy for your personal, lawful purposes on supported devices, subject to these terms and the applicable App Store terms. The iOS application license is also subject to Apple’s Standard End User License Agreement, where applicable. These terms supplement that license without reducing rights you have under it or applicable law.
Do not use the app unlawfully, interfere with its operation, redistribute it without authorization, or misuse its content. Restrictions on copying, reverse engineering, or modification apply only to the extent allowed by law and the applicable license.
3. Alarms, reminders, and device controls
You are responsible for selecting the correct alarm time, repeat days, sound, and mission, and for allowing the permissions the features need. Test your setup on your own device before relying on it.
Alarm and notification delivery can be affected by permissions, device state, battery, volume, audio routing, Focus settings, operating-system behavior, app termination, or software issues. After an unfinished real mission begins, the app may schedule recurring reminders and resume sound when reopened. iOS can delay, group, silence, or block reminders. Force-closing the app can end its audio playback; a powered-off device cannot ring.
Mission completion stops the app’s active mission sound and cancels its associated reminders. iOS retains its own system alarm and notification controls. Pushy cannot prevent you from using those controls, force-quitting the app, changing permissions, or uninstalling it. The app does not guarantee continuous ringing or that you will wake up at a particular time.
4. Safe use of missions
Choose a comfortable mission and target. Hold your device securely during Shake missions and use gentle, controlled movements. Stop any activity that causes discomfort or could put you, another person, or your device at risk. Do not interact with missions while driving, operating machinery, or performing another activity that requires attention.
Pushy is a general wellness and productivity tool, not a medical device, emergency service, or treatment for a sleep condition. It is not intended as the sole reminder for medication, medical care, emergencies, or other safety-critical events. Any estimates or progress statistics are informational and do not promise health, sleep, or productivity outcomes.
5. Your information
The Privacy Policy explains local storage, permissions, support messages, and your choices. You are responsible for information you enter and for protecting access to your device. We cannot restore local data that we have not received.
6. Availability, updates, and third parties
Features may change, require compatible hardware or an operating-system update, or become unavailable. We do not promise uninterrupted operation, permanent availability, or support for every device. Apple services, email applications, and websites linked from the app are provided under their own terms and policies.
Before removing the app, delete any system alarms you no longer want. You can stop using the app at any time.
7. Intellectual property
The app’s original software, interface, artwork, and other content belong to the developer or their licensors. These terms do not transfer ownership to you. Third-party names and trademarks belong to their respective owners.
8. Warranties and responsibility
To the extent permitted by applicable law, Pushy is provided “as is” and “as available,” without additional warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or guaranteed alarm delivery.
To the extent permitted by applicable law, we are not responsible for indirect or consequential loss arising from missed alarms, interrupted reminders, data loss, or use of the app. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights. Any statutory guarantees and remedies that apply to you remain available.
9. Changes and questions
We may update these terms as the app evolves. The revised date identifies the current version; additional notice will be provided where required. If you disagree with an update, you may stop using the app. Applicable mandatory legal rights are unaffected.
